terms of service

Thank you for your interest in my commissions!Due to my commissions being cleared for commercial use, I have to write in fancy legal language.TLDR;
1. I reserve the right to reject commissions if ur mean to me or if you cant give me legible references. 2. there is an extra charge if its too complex.
3. i may stream me making your commission unless you ask me not to.
4. you must pay before i start working on it.
5. any MINOR changes must be done in the sketch stage if you ask for wips. you are responsible for being clear and concise in your request and i WILL NOT redraw art if you decide that you do not like the pose that you have given to me. it is the expectation of the artist that the nature of the client's request is true to the submitted requirements.
6. there are no refunds past the sketch stage unless i initiate it (ex. cant finish due to health or personal issues).
7. once done you gotta credit me and dont make any changes. if you do a chargeback i will go feral.
8. DO. NOT. MAKE. NFTS OF YOUR COMMISSIONED WORK. I do not support NFTs and I will not tolerate it AT ALL. IF YOU MAKE AN NFT OF MY ART 100% OF ANY PROCEEDS FROM IT MUST GO TO ME. THIS IS IN THE CONTRACT BRO. DONT DO IT

requesting a commission

These terms are subject to change, and must be reviewed prior to commissioning.
Commissioning the artist constitutes an agreement to the terms of service below.PART I. REQUESTING YOUR COMMISSION
Violating any part of these terms may result in rejection of your commission.
1 Each customer must abide by the following guidelines:
(a) Provide legible references relevant to the commission type; and
(b) Act in a civil manner expected of a reasonable person.
(c) Unless specifically requested, allow their work in progress and finished commission to be used in promotional materials such as:
(i) Posts on the creator's Twitter (@mahoyoma)
(ii) Work streams on the creator's Twitch (twitch.tv/mahoyoma)
LIVE2D COMMISSIONS
2 Each customer requesting a Live2D commission must provide:
(a) References in the form of:
(i) Photos of the character; and
(ii) Description of the character's personality in a bulleted list
(b) Clearly stated pose requirements; and
(c) Clearly stated expression requirements.3 Each customer may be subject to extra charges at the time of request if their character:
(a) Requires multiple appendages outside of the range of typical human appendages;
(b) Requires more than 5 separate layers of hair, not including bangs;
(c) Requires more than 10 separate layers of accessories;
(d) Requires more than 3 custom expressions; or
(e) Does not have any existing photo references and requires character designing.4 Should a character be subject to extra charges under section 3(e), the customer must provide:
(a) Clothing references in the form of:
(i) Photos of desired clothing; and/or
(ii) Description of the formation of the outfit in a bulleted list
(b) Hair references in the form of:
(i) Photos of desired hair; and/or
(ii) Description of the colour and style of the hair in a bulleted list.
(c) Body references in the form of:
(i) Photos of desired body and skin type; and/or
(ii) Description of the skin and body in a bulleted list.ART COMMISSIONS
5 Each customer requesting an art commission may refer to section 2 for reference requirements. Additional reference requirements include:
(a) CONCISE request for pose and image composition (ie. sitting at 3/4 angle). Once the client has confirmed that this is the pose and composition they require for the image, it CANNOT be changed unless a sketch has not been completed.6 Each customer may be subject to extra charges at the time of request if their character:
(a) Requires multiple appendages outside of the range of typical human appendages;
(b) Does not have any existing photo references and requires character designing.
(c) Requests a change to the overall composition of the image once the sketch is completed that is contrary to the provided references. (ie. the original request was to have the character sitting at a 3/4 angle but then want it to be at a front-on angle).7 Should a character be subject to extra charges under section 6(b), the customer may refer to section 4.STREAM OVERLAYS
8 Each customer requesting an overlay will be provided with a document that states all requirements for the chosen overlay package. Each customer must refer to and complete the document in full. The requirements CANNOT be changed after submission.EMOTE COMMISSIONS
9 Each customer requesting an emote commission must provide:
(a) References in the form of:
(i) Photos of the character; and
(ii) Description of the character's personality in a bulleted list
(b) Clearly stated expression requirements.
10 Each customer may be subject to extra charges at the time of request if their character does not have any existing photo references and requires character designing.11 Should a character be subject to extra charges under section 10(e), the customer may refer to section 4.

getting your commission

12 In order for the creation process to begin, each customer must:
(a) Provide their Paypal for invoicing; and
(b) Pay through the Paypal invoice either;
(i) Partially at the minimum amount provided on the invoice; or
(ii) In its entirety.
13 Work in Progress (WIP) images will not be provided, unless:
(a) The customer requests it in writing; or
(b) The total price of the order equals or exceeds $70.
14 Changes to a completed piece will not be provided, unless:
(a) The change pertains to technical error such as colouring or shading; or
(b) The change pertains to design error, only if clear references were provided.USAGE POLICY
15 In using the completed product, the customer must:
(a) Credit the artist's Twitter page (@mahoyoma);
(b) Refrain from making any alterations to the artwork without permission from the artist.REFUNDS AND CHARGEBACKS
16 Refund requests will not be provided in any circumstance unless:
(a) Less than the sketch has been completed;
(b) The artist deems that they are unable to complete the commission in a timely manner due to extenuating circumstances.
17 Any customer who has received a completed piece and attempts to perform, or succeeds in performing a fraudulent chargeback or Paypal dispute, will be blacklisted from commissioning, as well as have identifying details released to the public, and all rights to use the image seized by the artist.18 Any customer who uses the commissioned work for reasons related to non-fungible tokens (NFT) will be barred from commissioning again. If it is discovered that the art was made into an NFT, the NFT must be removed from the platform or else 100% of any sale of the NFT must go to the artist.
